John D. Goodman

Attorney John Goodman has almost four decades of experience practicing law in the high country.

A third-generation lawyer, John was born in Cleveland; Ohio in 1961. He was raised in Kansas City, Missouri and admitted to practice law in 1989 in the Colorado Supreme Court and US District Court, District of Colorado.

John has been engaged in the private practice of law in Vail, Colorado and surrounding communities from 1989 through the present, appearing in municipal courts, Eagle County Court, Eagle District Court, The Colorsdo Court of Appeals, The Colorado Supreme Court, US District Court For Colorado, US Bankruptcy Court, and Wyoming Supreme Court, pro-had vice.

EDUCATION:  University of Denver (B.A. 1983); Seattle University School of Law (J.D. 1987).

LECTURER:  University of Denver Adjunct Professor, Human Communication Studies “Philosophy and Values of Law” (1998 – 2005).  Lorman Education “AIA Contracts Methods of Project Delivery” and “Owner Issues in Dealing with the Contractor and Architect” (2005).

MEMBER:  Continental Divide, Colorado Bar Association.  Director, National Board of Directors, American Judicature Society.  Member National Advisory Council American Judicature Society, and Judicial Independence and Accountability Task Force Committee.  Director, Vail Junior Hockey Association.  Director, Ski Club Vail.  Member, Eagle Valley Home Builders Association and Community Associations Institute, Eagle County Pretrial Services Committee, community stakeholder.

EXPERT WITNESS:  With almost 40 years of litigation experience Mr. Goodman is available as an expert witness concerning lode star analysis concerning reasonableness of attorney's fees and fee shifting provisions of contracts, and statutory awards of attorney's fees. Mr. Goodman has experience with attorney's fees awards in condominium and homeowner's association under the Colorado Common Interest Ownership Act and in all types of family law and domestic cases. Deposition testimony for plaintiff concerning reasonableness of attorney fees for real estate attorneys, Eagle District Court Lindholm et al., v. William J. Post, 2005 CV 287.  Other cases involve live testimony or affidavits concerning fee awards for clients or in fee dispute cases.

REPORTED CASES:  Corcoran v. Sanner, 854 P.2d 1376 (Colo. App. 1993); Wright v. Vail Run Resort Community Association, Inc., 917 P.2d 364 (Colo. App. 1996).

AWARDS: Colorado Legal Aid/Continental Divide Bar Assn. Pro Bono Awards (1991 – 2001, 2006, 2009, and 2010). Supported Eagle County legal clinic in Avon, Colorado and Pitkin County Senior legal aid program in the 9th Judicial District.

PRACTICE AREAS: Civil litigation; real estate, land use, zoning, easements, purchase and sale agreements, partition, boundary disputes, covenant enforcement; contracts; construction law including defects, soil subsidence, moisture intrusion, mold, insurance claims; entity formation; commercial transactions and leases; residential and commercial owners associations, including drafting, interpreting and enforcement of covenants, common interest community declarations, bylaws, rules and regulations and responsible governance policies; family law including dissolution of marriage, mediation, allocation of parental responsibilities, custody, child support, decision-making, spousal support, marital property division, and post decree matters.
